ORDER:

This petition is filed to withdraw O.P.No.2032 of 2014 from the Court of IX Additional Chief Judge, City Civil Court, Hydeabad and transfer the same to the court of XIV Additional District Judge, at L.B.Nagar, to be tried with Arbitration O.P.No.540 of 2014 pending there. First petitioner herein filed a claim petition before Arbitral Tribunal in respect of Development Agreement-cum-General Power of Attorney dated 11-8-2006 and respondents 2 to 4 herein passed an award on 23-5-2014. Challenging the said award, petitioners herein filed O.P.No.2032 of 2014 before IX Additional Chief Judge, City Civil Court, Hyderabad whereas first respondent also filed a petition challenging the award which is registered as A.O.P.NO.540 of 2014 pending on the file of Principal District Judge, Ranga Reddy District at L.B.Nagar.

First respondent, in spite of service of notice neither appeared in person nor through any advocate.

Considering the reasons stated in the affidavit and also considering the fact that both parties filed petitions challenging award dated 23-52014, I feel that the request of petitioners can be considered. For these reasons, O.P.No.2032 of 2014 is withdrawn from IX

Additional Chief Judge, City Civil Court, Hyderabad and transferred to the XIV Additional District Judge, at L.B.Nagar, to be tried with Arbitration O.P.No.540 of 2014.

Petition is ordered accordingly. No costs.
