THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12520 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against petitioners/accused Nos.1 and 2 in FIR No.71 of 2016 of Garladinne Police Station, Ananthapuram District, registered for the offences punishable under Sections 324 and 307 read with 34 IPC.

Heard and perused the material available on record. A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings. In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, there shall be stay of all further proceedings in FIR.No.71 of 2016 of Garladinne Police Station, Ananthapuram District, including arrest in so far as petitioner No.2/A2 is concerned till 20.09.2016. In the mean time, it is open to petitioner No.2/A2 to approach the Court concerned and obtain appropriate orders. The petition against petitioner No.1/A1 concerned is dismissed.

Accordingly, the Criminal Petition is disposed of as against petitioner No.2/A2 and dismissed as against petitioner No.1/A1. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
