HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.31348 of 2015 ORDER:

Heard Dr. K. Manmadha Rao, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj, Sri MSR Chandra Murthy, learned special counsel for the 3rd respondent and Sri G. Seshadri, learned standing counsel for the 4th respondent.

2. The petitioner is the Field Assistant of Ayyavaripalli Village, Valetivaripalem Mandal, Prakasam District. Levelling certain allegations against the petitioner, a show cause notice dated 08.05.2015 was issued to him and after receiving his explanation, an enquiry was conducted and he was removed from service vide impugned order dated 29.05.2015 of the 3rd respondent. Learned counsel appearing for the petitioner submits that the allegations are all baseless and without considering the explanation submitted by the petitioner, the impugned order was passed removing the petitioner from service. Since an efficacious alternative remedy by way of appeal is available to the petitioner, I am not inclined to examine the merits of the case.

In the circumstances, the writ petition is disposed of directing the petitioner to file an appeal before the Appellate Authority within the 15 days from the date of receipt of a copy of this order and on submission of the appeal, the Appellate Authority is directed to dispose of the said appeal in accordance with law, after affording opportunity of hearing to the petitioner, within a period of eight (8) weeks from the date of filing of the appeal.
