THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30798 OF 2017 O R D E R:

Notice dated 08.09.2017 issued by the 4th respondent District Coordinator, A.P. Social Welfare Residential Educational Institutions Society, inviting tenders for supply of food provisions for the academic year 2017-18 to the A.P. Social Welfare Residential Junior Colleges and Schools running under its control, is challenged in this Writ Petition.

The simple case of the petitioners is that the contract awarded in their favour for the academic year 2016-17 is being renewed from time to time and hence, the issuance of the impugned tender notification is not at all justifiable. Heard learned counsel for the petitioners as well as learned Government Pleader for Social Welfare (Andhra Pradesh). Mere award of the contract in favour of the petitioners and its extension from time to time, does not confer any vested right in them, so as to grant the relief of the nature sought for in this Writ Petition. Inasmuch as the tender notification dated 08.09.2017 has been issued, the petitioners, being eligible persons, are always at liberty to participate in the tender process and quote their price. If they become the successful bidders, it is needless to say, they will be awarded the contract.

The Writ Petition is therefore, disposed of. However, it is made clear that till the finalisation of the tender process, pursuant to the notification, the petitioners may be continued to supply the

provisions, in terms of the contract that is being awarded and extended from time to time. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
