THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.9653 of 2013 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader appearing for respondent Nos.1 to 3. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent police in not taking any action on the complaint on 10-3-2013 given by the petitioner against the unofficial respondents, inspite of the repeated visits, as being illegal, arbitrary and unjust and consequently direct the Respondent police to forthwith act upon the complaint dt.10-3-2013 and to take immediate action in accordance with Law, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

During the course of hearing, learned Government Pleader placed on record the written instructions, dated 16.04.2013, issued by the Station House Officer, Madannapet Police Station, Hyderabad. 4.

From the perusal of the said written instructions, it is revealed that on the complaint lodged by the petitioner on 10.03.2013, a case in Crime No.62 of 2013 for the offence under Sections 448, 504 and 506 read with 34 IPC has been registered on 10.04.2013 against respondent Nos.4 to 10 herein as accused. The matter is under investigation at the timer of issuance of the written instructions.

Since the grievance of the petitioner in the present writ petition is that the respondent police are not taking any action on his complaint and since a crime is already registered pursuant to his complaint, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the writ petition is closed.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
