HON'BLE SRI JUSTICE S.V. BHATT W.P. No.15855 OF 2013 ORDER:
The petitioner prays for the following relief" "...Writ of Mandamus, to declare the action of the respondent police in not taking any action on the complaint dt. 20-5-2013 given by the petitioner against the Respondent Nos. 4 to 10, as being illegal, arbitrary and unjust and consequently direct the respondent police to forthwith act upon the complaint in accordance with law..."
Respondent No.3 basing on written instructions dated 11.06.2013 states that the complaint referred in the writ petition is not received by 3rd respondent.
Keeping in view the objection of 3rd respondent, the annexures filed along with the writ petition are examined. The petitioner is discharging initial burden by not only presenting the complaint but also filing postal receipts to that effect. The written instructions dated 11.06.2013 read thus: " ..It is respectfully submitted that in the absence of receipt of any complaint from the petitioner herein, this respondent is unable to initiate any action against the unofficial respondents herein.
It is respectfully submitted that if the petitioner approaches this respondent, this respondent will certainly take necessary action on the complaint of the petitioner herein by duly following the procedure."
Placing on record the written instructions, the writ petition is disposed of. No order as to costs.
