THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11411 of 2016 ORDER:

Heard Sri Kuna Reddy Anji Reddy, learned counsel for the petitioner, and Sri Md. Saleem, learned Standing Counsel for the Gudur Municipality.

The prayer of the petitioner in this case is as under: "To issue a writ order or direction more particularly in the nature of writ of mandamus declaring the illegal action of the respondents not considering or not taking any steps on the representations dated 2502-2016 requesting not to remove dustbin located for last 40 years in Yellawari Street Gudur, Gudur municipality is illegal, arbitrary and violation of Article 14,19, and 21 of the Indian Constitution consequently direct the respondent to consider the representations dated. 25-02-2016 given by the petitioner requesting not to remove municipal dustbin at Yellawari street Gudur, Gudur municipality, Nellore District and pass such order or orders whichever this Hon'ble Court may deem fit and proper in the interest of justice." As the petitioner's representation dated 25.02.2016 is still pending consideration before the authority concerned, this Court sees no reason to entertain this writ petition for adjudication on merits at this stage.

The writ petition is accordingly disposed of directing the Gudur Municipality to consider the representation dated 25.02.2016 made by the petitioner in accordance with law and take appropriate action thereon, as warranted. Due notice and opportunity of hearing shall be given to all parties who may be affected by any decision taken upon the said representation.

This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
