The Hon'ble Sri Justice A.Rajasheker Reddy Writ Petition No.5811 of 2017 Order:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.3 in entering the name of respondent No.4 in online records and revenue records in respect of the petitioner's ancestral land admeasuring Ac.1-50 cents in Survey No.350 of Ananthasagar Mandal, Managallu Village, SPSR Nellore District, as illegal and arbitrary. The petitioner sought for a consequential direction to respondent No.3 to delete the name of respondent No.4 and enter the names of his family members in the said records.
Heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Revenue (AP) for respondent Nos.1 to 3.
The learned Assistant Government Pleader for Revenue (AP) submitted that if the petitioner has any grievance regarding correction of entries in the revenue records, he has to avail the remedy of appeal under Section 5(5) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') or revision under Section 9 thereof.
ARR, J W.P.No.5811 of 2017 Dt: 20-02-2017 The petitioner, without availing the said remedy, has approached this Court for a direction to respondent No.3 to delete the name of respondent No.4 and enter the names of his family members in the said records.
At this stage, the learned Counsel for the petitioner requested that liberty may be granted to the petitioner to avail the remedy of appeal under the provisions of the Act. Having regard to the same, this Writ Petition is disposed of granting liberty to the petitioner to avail the remedy of appeal or revision under the provisions of the Act. As a sequel to disposal of the Writ Petition, WPMP.No.7088 of 2017, filed by the petitioner for interim relief, is disposed of as infructuous.
