THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.2166 of 2016 ORDER:

This contempt case was instituted alleging wilful disobedience to the order dated 13.04.2016 passed by this Court in W.P.M.P.No.15471 of 2016 in W.P.No.12336 of 2016. The order passed by this Court however pertains to the alleged peaceful possession of the petitioners over their premises bearing Door Nos.59A-5-12 and 59A-6-11-2 situated at Patamata of Vijayawada Municipal Corporation Limits, Krishna District. The allegation presently however is not in relation to the premises bearing the aforestated door numbers but with regard to the action of the municipal authorities in relation to the road outside the said premises. The said road would not fall within the ambit of the interim order which was restricted to the alleged peaceful possession of the petitioners over the premises bearing the mentioned door numbers.

This Court therefore finds no cause made out for exercise of contempt jurisdiction. The contempt case is accordingly dismissed. This order shall however not preclude the petitioners from taking recourse to fresh proceedings in accordance with law in relation to their grievance, if any. No order as to costs.
