THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9166 of 2017 ORDER:

This petition is filed, by the petitioner-accused No.1, under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.355 of 2010 on the file of the Station House Officer, Vanasthalipuram Police Station, Cyberabad, registered for the offences punishable under Sections 498-A and 506 I.P.C., and Sections 3 and 4 of the Dowry Prohibition Act.

At the time of hearing, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C. to recall the Non-Bailable Warrant (N.B.W.) issued against him on the same day.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the petitioner, the learned VII Metropolitan Magistrate, Cyberabad, is hereby directed to dispose of the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C. to recall the N.B.W. issued against him on the same day in accordance with law.
