HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 32213 OF 2015

PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Dr. J. Vijaya Lakshmi, learned counsel for the petitioner, on instructions from her client, who is present in the Court, prays for withdrawal of the writ petition with liberty to the petitioner to file appropriate proceedings before the Family Court for appropriate relief.

Writ petition is disposed of as not pressed with liberty as prayed. It is made clear that if any proceedings along with an application for interim relief are filed by the petitioner, the Family Court shall consider and deal with the same on merits in accordance with law and uninfluenced by the observations made either in this order or earlier orders passed by this Court. It is also made clear that we have not examined the merits of the case insofar as the custody of the children is concerned.
