THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42431 OF 2016 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in maintaining the suspect sheet against the petitioner in Mughalpura Police Station, Hyderabad, as illegal and arbitrary, and consequently direct the respondents to close the suspect sheet against the petitioner and to remove the photographs of the petitioner in Mughalpra Police Station, Hyderabad, Hyderabad District.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in one case in 2014 and that the said case was compromised between the parties before the Lok Adalat. However, subsequent to filing of the charge sheet in the said crime, a suspect sheet was opened against the petitioner in 2015. He further submits that except the said case, no other case was registered and pending against the petitioner and as such, the petitioner made application dated 28.11.2016 for closure of the suspect sheet and that the respondents did not close the suspect sheet. Hence, he prays this Court to direct the respondents to close the suspect sheet against the petitioner. Considering the facts and circumstances of the case, the third respondent herein is directed to consider the representation of the petitioner, dated 28.11.2016 and pass appropriate orders as expeditiously as possible, preferably within a period of three months from the date of application of the petitioner.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 28.12.2016 pln
