THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10476 OF 2018 ORDER:
This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.2, for grant of bail in Crime No.75 of 2018 of Machavaram Police Station, Guntur District, registered for the offences punishable under Sections 120-B, 109 and 302 read with Section 34 of I.P.C.

Heard the learned counsel for the petitioner/A.2 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.
The learned counsel for the petitioner/A.2 would submit that there are no direct witnesses to the alleged offence. The petitioner/A.2 is in judicial custody from 20.08.2018 and investigation was completed and ultimately, prayed to allow the petition.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.2.

The petitioner/A.2 was found in the varandah of the house of the deceased-Koya Sarojanamma and the same was noticed by the de facto complainant-L.W.1 i.e., son of the deceased. There is record to show that the petitioner/A.2 had got illegal intimacy with A.1-wife of the de facto complainant. There are specific and grave allegations against the petitioner. The alleged offence is punishable for death or imprisonment for life. Release of the petitioner at this stage would hinder the investigation. There are no justifiable grounds to allow the petition at this stage.

In the result, the Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
