HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 5121 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in issuing U.O.Note No.28458/SC/2001, dated 26.06.2001, informing the Assistant Registrar (NTE) that the orders of the University issued vide proceedings dated 08.04.1999 exempting the employees appointed prior to 1981 and who have crossed 53 years of age from passing the account test, holds good, in addition to the latest orders of the University issued vide Circular Memo dated 17.02.2001, as illegal and arbitrary.

Since the petitioners had retired from service during pendency of the writ petition, the cause in the writ petition does not survive. Therefore, the writ petition is dismissed as infructuous.
