This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner-A.3 in the Cr.No.104 of 2015 of Ibrahimpatnam Police Station, Vijayawada City, registered for the offences punishable under Sections 420,506,509,406 and 102(B) read with Section 34 of I.P.C. and under Section 15 of the A.P. Protection of Depositors of Financial Establishments Act, 1999(for short, 'the APPDFE Act') on the complaint of 2nd respondent, praying to quash the proceedings in said crime.
2. Heard the learned counsel for the petitioner/A.3 so also the learned Public Prosecutor representing State-1st respondent before ordering notice to the 2nd respondent/defacto-complainant and perused the material on record. 3 . On perusal of the First Information Report, it shows that there is accusation against the petitioner herein and the investigation is when pending, there is nothing to quash the F.I.R. but for the facts otherwise admit the entitlement of the bail. The petitioner being a Government servant thereby, the Criminal Petition is disposed of giving liberty to the petitioner-A.3 to surrender before the learned Special Judge, under the APPDFE Act and move an application for regular bail with a notice to the Public Prosecutor concerned and in such an event the learned Judge shall grant bail preferably on the same day if not on the next day, with necessary conditions.
