THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11606 of 2012 ORDER:

The grievance of the petitioner was as to the maintenance of a rowdy sheet in his name on the file of Nandyal II Town Police Station, Nandyal, Kurnool District.

The Sub-Divisional Police Officer, Nandyal Sub-Division, Kurnool District, filed a counter-affidavit detailing the involvement of the petitioner in five criminal cases between the years 1996 and 2013. He further stated that a rowdy sheet was opened in the name of the petitioner in the year 2010 and that the same is presently extended up to the end of this year. He further stated that the petitioner was not involved in any criminal case after the year 2013 and that he was residing at Hyderabad now and was only visiting Nandyal now and then, where he has his permanent residence. The Sub-Divisional Police Officer further stated that the police authorities were taking steps to close the rowdy sheet opened in the name of the petitioner after reviewing the same.

In the light of the aforestated facts and as the police authorities themselves seek to review the necessity to continue with the rowdy sheet in the name of the petitioner when he is not a resident of the Nandyal Town, no adjudication on merits is warranted in this case. The writ petition is accordingly disposed of directing the police authorities concerned to apply their mind and take a decision in the matter forthwith in accordance with law as to the necessity to maintain a rowdy sheet in the name of the petitioner on the file of Nandyal II Town Police Station, Nandyal, Kurnool District. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
