ORAL ORDER:
Petitioner claims that he has applied for grant of building permission to construct shopping complex on land admeasuring 328 sq yards in Survey No. 358, Block No.5, Narayanpur Cross Roads, Choutuppal village and mandal, Nalgonda district and permission is not granted.

When the matter is taken up, learned standing counsel for Gram Panchayat points out that Choutuppal village is no more a Gram Panchayat and it has become Municipality, further, as per Hyderabad Metropolitan Development Authority Act,2008 (for short HMDA Act) whenever a person is intending to construct commercial complex, he must apply to HMDA, whereas no such application is made and application was made only to Gram Panchayat.

Having regard to this submission, learned counsel for petitioner seeks leave of the Court to submit appropriate application to HMDA seeking building permission for construction of commercial complex. Granting leave as sought for, writ petition is dismissed. No costs.
