THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.4995 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners / A.1 to A.4 in C.C.No.380 of 2012 on the file of the Court of the Judicial First Class Magistrate, Armoor, Nizamabad District.

At the time of arguments, the learned counsel for the petitioners sought permission of the Court to permit the petitioners to withdraw the petition with liberty to avail the remedies available to them under law. He further requested that the presence of the petitioners before the trail Court may be dispensed with on each and every date of adjournment. Permission is accorded. 3 In the result, the petition is dismissed granting the liberty as prayed for. There is no dispute with regard to the identity of the petitioners who are A.1 to A.4 in the case. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the 2nd respondent. Hence, the presence of the petitioners who are A.1 to A.4 in C.C.No.380 of 2012 on the file of the Court of the Judicial First Class Magistrate, Armoor, Nizamabad District is dispensed with on each and every date of adjournment. However, the petitioners shall appear before the trail Court as and when their presence is so required. Consequently, miscellaneous petitions, if any, pending in this petition, shall stand closed.
