Both Kommaraiah v. The Singareni Collieries Company Ltd.,

HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.18618 and 18632 of 2016 COMMON ORDER:

1. These two writ petitions are being disposed of by this common order at the admission stage after hearing the learned Counsel for the petitioners as well as the learned Standing Counsel for the respondents.

2. These two writ petitions relate to the challenge made to the orders of transfer when the petitioners are working in Yellandu area of Khammam District. The petitioner in W.P.No.18618 of 2016 was transferred to Bhoopalpally of Warangal District, whereas the petitioner in W.P.No.18632 of 2016 was transferred to Ramagundam area of Karimnagar District.

3. The transfers are made on administrative grounds in a routine manner. In view of the same, this Court cannot interfere with the orders of transfer. However, the learned Counsel for the petitioners submits that the petitioners are having less than 24 months of service and, therefore, they should not have been transferred at the fag end of their service before retirement.

4. It is for the employer to consider the request of the petitioners and without expressing any opinion on merits of the case, liberty is given to the petitioners to submit a representation to respondents 1 and 2 within a period of one week from the date of receipt of a copy of this order and on receipt of such representation, the respondents 1 and 2 can consider the same and pass appropriate orders thereon within a period of four weeks thereafter.

5. With the above observation, these two Writ Petitions are dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
