HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40481 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the inaction on the part of the 4th respondent in considering the application filed by the petitioner on 26.09.2016 for mutation in respect of land admeasuring Acs.16.05 guntas in survey No.76/AA of Appareddypally Village, Madgula Mandal, Mahabubnagar District (now Ranga Reddy District), as illegal and arbitrary. Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the 4th respondent for disposal of the online application filed by the petitioners on 26.09.2016. Learned AGP would submit that the 4th respondent may be directed to dispose of said application, if the same is still pending consideration, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to consider and dispose of the online application filed by the petitioners on 26.09.2016 seeking mutation in respect of subject

land, if the same is still pending consideration, after hearing the petitioners and other aggrieved persons, if any, and also after perusing the material on record, in accordance with law, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
