CVNR,J C.R.P.No.2231 of 2017 28.04.2017 ORDER:

This civil revision petition arises out of order, dated 23.03.2017, in I.A.No.34 of 2015 in O.S.No.106 of 2010 on the file of the Senior Civil Judge, Chodavaram, Visakhapatnam District.

By the aforementioned order, the Court below has appointed an Advocate Commissioner to measure and localize the suit land with the help of the Mandal Surveyor with reference to the land sold to the petitioner/defendant under registered sale deed, dated 12.09.2005. 3.

After hearing the learned counsel for the petitioner, I do not find any error in the order of the Court below. After all, survey of the suit land pending the suit would help to elucidate the matters in dispute and therefore, by such survey, no prejudice will be caused to the petitioner's interests. In this view of the matter, I do not find any reason to interfere with the order of the Court below.

The Civil Revision Petition is, accordingly, dismissed. 5.

As a sequel to dismissal of the C.R.P., C.R.P.M.P.No.2910 of 2017 filed by the petitioner for interim relief shall stand dismissed as infructuous.
