HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29678 of 2017 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondents in not disposing the petitioner's representation, dated 19.08.2017, as illegal, null, void and arbitrary and consequently direct the respondents to relieve from TSSPDCL to join in APSPDCL. 2.

Heard Sri K. Durga Prasad, learned counsel for petitioner, learned Government Pleader for Energy for respondents 1 & 2, Sri R. Vinod Reddy, learned Standing Counsel for the 3rd respondent & Smt. Jagarlamudi Koteswari Devi, learned Standing Counsel for the 4th respondent and with their consent, the writ petition is taken up for disposal at the stage of admission. Perused the material available on record.

The case of the petitioner is that the petitioner is Graduate in Engineering and is physically handicapped person with 90% disability of one leg and joined in the then APSEB as Assistant Engineer on 20.08.1986 at Hyderabad and he worked in the Corporate Office in Operation Wing and that he got promotion in the year 1997 as Assistant Deputy Engineer and in the year 2005 as Deputy Engineer and finally, he got promotion as Superintendent Engineer in the year 2011 and since then, he is working as Superintendent Engineer in the Head Office at Hyderabad. 4.

The main grievance of the petitioner is that the petitioner made a representation to the Government of Andhra Pradesh giving the option to go to Andhra Pradesh State on 19.08.2017, but till now,

>>2<< ARR, J W.P.No.29678 of 2017 the same is not disposed of. The petitioner is retiring at the age of 58 years on 31.08.2017 and if the petitioner's case is considered for repatriation to Andhra Pradesh State, he will have the benefits of retirement at the age of 60 years.

When the matter is taken up, learned counsel for both the parties agreed for disposal of the writ petition with a direction to the 4th respondent to expeditiously dispose of the representation of the petitioner, dated 19.08.2017.

Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the 4th respondent to consider the representation of the petitioner, dated 19.08.2017, pass appropriate orders, as warranted by law, as expeditiously as possible, and communicate the decision to the petitioner. There shall be no order as to costs.
