THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18965 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction, more particularly in the nature of a Writ of Mandamus declaring the actions of the respondents in demolishing the construction and interfering with the constructions made by the petitioner without following due process of law as being arbitrary, illegal, unconstitutional and violative of the principles of natural justice." 2.

The main grievance of the petitioner is that the respondent Corporation is interfering with the constructions made by the petitioner in Plot No.90 in Sy.No.113/1 & 2 of J.V.Colony, Gachibowli (V), Serilingampally without following the due process of law.

When the matter is taken up, learned Standing Counsel appearing for the respondent Corporation submitted that if the respondent Corporation intends to demolish any unauthorised constructions made by the petitioner, it will proceed only in accordance with law and that the Corporation will not take any coercive steps against the petitioner without following the due process of law.

Recording the submission of the learned Standing Counsel, this writ petition is disposed of directing the respondent Corporation not to interfere with the constructions made by the

petitioner and also not take any coercive steps against the petitioner without following the due process of law. There shall be no order as to costs.

5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
