This petition is filed under Section 24 of C.P.C. seeking to withdraw F.C.O.P.No.270 of 2015 from the file of the VI Additional District Judge-cum-Family Court, Nellore, and transfer the same to the file of the Judge, Family Court at Tirupathi, Chittoor District. 2.

Sri Rajender Khanna, the learned counsel, takes notice on behalf of the respondent.

Learned counsel for the petitioner submitted that the petitioner was set ex parte on 29.06.2018.

Learned counsel for both parties submitted that the petitioner filed an application under Order IX Rule 9 C.P.C. to set aside the ex parte order dated 29.06.2018.

In view of the submission made by the learned counsel for both parties, no further orders are necessary in this transfer petition.

Hence, the Transfer Civil Miscellaneous Petition is closed. However, closing of this transfer petition does not preclude the petitioner to file a similar type of petition. There shall be no order as to costs.
