HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.16720 of 2011 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents, in interfering with the erection of the towers by the petitioner company at H. No.33-25-35, Bellapu Shobanadri street, Suryaraopet, Vijayawada, Krishna District and H. No.21-0-6, Main Road, Madhuru Nagar, Vijayawada, Krishna District by virtue of deemed permission, without issuing any notice and without following due process of law, as arbitrary and illegal. Smt. G. Jhansi, Learned Standing Counsel for the respondent, would draw my attention to the averment in the counter-affidavit that the respondent-Commissioner has never interfered with the functioning of the tower erected by the petitioner company. In the light of the aforesaid assertion, it is evident that the petitioner's apprehension, of interference by the respondent, is unfounded. The cause in the Writ Petition does not, therefore, survive necessitating any further adjudication by this Court. The Writ Petition is closed. The miscellaneous petitions pending, if any, shall also stand closed. No costs.
