THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL REVISION CASE No.3016 OF 2016 JUDGMENT:
The present Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. challenging the order dated 07.10.2016 passed in Crl.M.P.No.8 of 2016 in S.C.No.1 of 2014 on the file of the Court of the V Additional District & Sessions Judge, Laxmipeta, Vngara Mandal, Srikakulam District.
At the time of arguments, the learned counsel for the petitioners seeks permission of the Court to permit the petitioners to withdraw the Revision Case with liberty to avail the remedies available to the petitioners under law. The learned counsel further submitted that the observations made by the trial Court in Para Nos.13 to 18 of the impugned order may come in the way of their defence during the course of trial. Permission is accorded.
It is needless to say that while disposing of interlocutory applications the Court shall not make any observations, which, may ultimately, affect the merits of the main case. In the result, granting the liberty as prayed for, this Criminal Revision Case is dismissed as withdrawn. The trial Court is hereby directed to proceed with the trial of the main case without being influenced by any of the observations and findings recorded by it in para Nos.13 to 18 of the impugned order.
