THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.735 of 2013 ORDER:
The order of this Court required the third respondent to consider the application submitted by the petitioners in Form VI(A) in terms of Section 4(1) of the Andhra Pradesh Rights in land and Pattadar Pass Books Act, 1971 and to pass orders within two months from the date of receipt of the application. A counter-affidavit is filed by the respondent-Tahsildar stating that an order was passed on 20.03.2013 rejecting the petitioners' application for grant of pattadar pass books as the petitioners were not in possession of the subject land.
Sri N.Ganeswara Rao, learned counsel for the petitioners, would submit that the application was erroneously rejected; and the finding, that the petitioners were not in possession, is not correct. All that this Court had directed the third respondent to do is to consider the application of the petitioners, and pass orders thereupon. The merits of the order passed by the third respondent cannot be the subject-matter of enquiry in contempt proceedings.
As the order of this Court has been complied with, the Contempt Case is closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
