HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.18123 of 2015 ORDER:

Heard the learned counsel for petitioners, the learned Government Pleader for Prohibition & Excise for respondents 1 to 6 and the learned counsel for respondent No.8.

This Writ Petition is filed challenging the order of the first respondent dated 28.04.2015 in I.A.No.19 of 2015 in O.P.No.8 of 2015 directing the petitioner Society, which is the tenth respondent in the OP, to produce its minutes book for the period from 20032004 to till date and also voters' list for the elections held in the year 2003-2004.

It is contended by the learned counsel for petitioner that they filed a petition on 28.04.2015 seeking adjournment of I.A.No.19 of 2015 in O.P.No.8 of 2015, but the first respondent passed the impugned order on the same day without considering the same. Ultimately, the first respondent disposed of their petition on 05.06.2015 holding that the reopening of the application is not possible.

4. It is submitted by the learned counsel for the petitioner that the record is maintained by the Secretary and the Secretary had to produce the record.

This Court does not find any illegality in summoning the record from the first petitioner Society pending O.P.No.8 of 2015. In view of the order passed by the first respondent, it is the responsibility of the Society to produce the record either through the Secretary or some other officer of the Society and assist the

first respondent in disposing of the matter in O.P.No.8 of 2015. In that view of the matter, this Court sees no reason to interfere with the order of the first respondent dated 28.04.2015.

6. The Writ Petition is, accordingly, dismissed. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
