THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CCCA MP No.246 OF 2016 IN/AND CCCA No.198 OF 2015 ORDER:

This petition is filed under Rule 3 of Order XXIII of the Code of Civil Procedure, 1908 to record compromise in CCCA No.198 of 2015, as both the parties settled the matter outside the Court towards full satisfaction.

Both parties present and they are identified by their advocates concerned on record. The terms of compromise are explained to them in Telugu. They admitted to be true and correct. Before this Court, learned counsel for the appellant handed over two cheques bearing Nos.001389 and 001390 dated 06.04.2016 each for Rs.5,00,000/-, to the respondents towards part satisfaction. Hence, I find that the compromise is voluntary.

Accordingly, the petition is ordered and the appeal is allowed. In terms of the compromise entered into by the parties to the suit, compromise decree is passed. No costs.

Miscellaneous petitions, if any, pending in this appeal shall stand closed.
