THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12947 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the action of the respondents in imposing the 7th condition in the impugned notice vide Letter No.58539/16/08/14/HO, dated 08.09.2016, as illegal and arbitrary and consequently, direct respondent No.3 to grant building permission for the proposed construction consisting of cellar, stilt + 5 upper floors in Plot Nos.18-C, 19-C, 20-C and 21-C in Sy.No.60 situated at Kondapur Village, Serilingampally Mandal, Ranga Reddy District. 2.

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.3 herein to consider the representation, dated 09.02.2017, of the petitioner and pass appropriate orders. Learned Standing Counsel appearing for respondent No.3 also submitted that respondent No.3 will consider the said representation and pass appropriate orders in accordance with law.

Considering the submissions of both sides, respondent No.3 is hereby directed to consider the representation, dated 09.02.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of three (3) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
