THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.32934 of 2017 ORDER:
Heard learned counsel for the petitioner and also learned Government Pleader for Revenue and Municipal administration respectively for respondents 1 to 6 and the learned Standing counsel who offers to file vakalath on behalf of the respondents 7 to 9 from the instructions and perused the prayer in the writ petition with the supporting affidavit.
Undisputedly, as pointed out by the learned Government Pleader and learned Standing Counsel supra, there is no document filed by the petitioner to claim any title over the property. However, without following due process, even if the petitioner is an encroacher, the respondents cannot take law into their hands. With these observations, the writ petition is disposed of, directing the respondents to follow due process of law, if at all to evict the petitioner.
