Md.Abdul Razzak v. The State Of Telangana
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.1 0 4 9 7 of 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner in the event of his arrest in an unregistered crime of Miyapur Police Station.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The Public Prosecutor submits that no crime is registered, as yet, against the petitioner. But the counsel for the petitioner submits that this is a civil dispute and that the police are pressurising him to come and settle the matter with the complainant.
4.
However, since there is no ground made out with regard to the apprehension of the petitioner that the case would be registered against him, this court opines that this is not a fit case for grant of anticipatory bail to the petitioner. 5.
In view of the above, the Criminal Petition is dismissed. However, if any case is registered against the petitioner, the police are directed to follow the guidelines enunciated by the Supreme Court in the case of Ar n esh Ku m ar v. St at e of Bih ar an d an ot h er ( Cr l.Appeal No.1 2 7 7 of 2 0 1 4 ) 1, before effecting the arrest of the petitioner.
1 (2014) 8 SCC 273
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
