HONOURABLE SRI JUSTICE P. NAVEEN RAO Writ Petition No.14473 of 2017 ORDER :

The petitioner is called for selection in January, 2015 for the post of Temporary Attender in Visakhapatnam District by the respondent-bank. 2.

In this writ petition the petitioner seeks that he should be empanelled as Temporary Sub-Staff/Attender.

On instructions, learned Standing Counsel for the respondent-bank submits that the selections conducted in January 2015 were finalized and there are no vacancies as of now and that subsequent to the notification in which the petitioner participated in the selections, two more notifications were also issued and selections were conducted, therefore, at this stage, the petitioner cannot be empanelled.

Learned counsel for the petitioner sought to rely on the directions issued by this Court in W.P.Nos.33787 and 30297 of 2015 and W.P. No.31700 of 2013 to contend that persons who are aged more than the petitioner's were considered.

As noted above, the petitioner's grievance may be valid, if he was overlooked on the ground of overage and others were considered, but petitioner ought to have been vigilant in seeking relief at appropriate time and before the selections were finalized. The subject selections were already finalized and these selections relate to January, 2015. The learned standing counsel for the respondent-bank asserts that subsequent to these selections,

two more selections were conducted; thus no relief as sought for by the petitioner can be granted at this stage.

The Writ Petition is accordingly dismissed. However, it is open for the petitioner to work out his remedies if he has any other grievances. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
