HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16971 OF 2017 ORDER:

The grievance of the petitioner is that, though he is in occupation of land admeasuring sq.

yards in Sy.No.291/1 situated at Nagaram Village, Keesara Mandal, Ranga Reddy District, and made application, on 27.02.2015, in terms of G.O.Ms.No.59 dated 30.12.2014, the same has not be considered till date. Hence the Writ Petition. It is the contention of the petitioner that he is in possession of the subject land for more than two decades and has dwelling unit thereat.

Learned Government Pleader for Revenue opposes the same and submits that the petitioner never had any dwelling unit in the subject premises and, only after making application, when the petitioner tried to make construction in the subject premises to satisfy the conditions of G.O.Ms.No.59 dated 30.12.2014, the respondent - authorities prevented him from making further construction. Having considered the respective submissions and, inasmuch as the application of the petitioner is said to be pending in terms of G.O.Ms.No.59 dated 30.12.2014, the same shall be considered and appropriate orders be passed in accordance with law. However, it is made clear that the petitioner shall not make any construction whatsoever and

respondent - authorities shall not interfere with his possession.

With the above observations, the Writ Petition stands disposed of.

Miscellaneous applications, if any, pending shall stand closed. There shall be no order as to costs.
