THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.2278 of 2015 ORDER :

The petitioner, who is A-3 filed the present application under Section 438 Cr.P.C. seeking enlargement on bail in Cr.No.56 of 2015 of Godavarikani I Town Police Station, Karimnagar District registered for the offences punishable under Sections 120-B, 489 (A) (B) (C) read with 34 IPC and Sections 17 and 18 of Unlawful Activities (Prevention) Act, 1967. The averments in the remand report filed before the Court would show that on 15-02-2015 at 0600 hours on reliable information that A-1 to A-6 were in possession of high quality fake Indian Currency notes and intending to use the same as genuine, the SI of police, Godavarikani I Town Police Station rushed to bus stand along with mediators and apprehended A-1 to A-4. During enquiry, insofar as A-3 is concerned, it is revealed that A-1 gave Rs.4.

00 lakhs fake currency notes in the month of October, 2014 and another Rs.4.00 lakhs high quality fake Indian Currency notes in the month of December, 2014 to the petitioner. In turn, the petitioner deposited Rs.23,000/- in the month of December, 2014, Rs.15,000/- and Rs.19,000/- in the month of January,2015 in the bank account of his brother-in-law by name Ripan Sarkar. It is further revealed that the petitioner gave some high quality Fake Indian Currency Notes to one Chetkuri Rajaiahwho is A-4 and Mahender who is A-11. As on the date of arrest and alleged seizure about 50,000/- worth fake currency notes were seized from the petitioner. Basing on these allegations, the above report came to be filed.

Learned counsel for the petitioner mainly submits that the petitioner is permanent resident of Katarm Village of Karimnagar District and since he is suffering with AIDS and he may be released on bail. Learned Public Prosecutor opposed the bail contending that the petitioner will be taken care of in the hospital separately and proper steps will be taken to see that he will not be mixed with other accused. The case of the prosecution that all the accused conspired and indulged

in circulation of high quality fake currency notes. Since the case is still at the stage of investigation and as substantial number of fake currency notes were recovered from the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed. It is needless to mention that if the petitioner is suffering from AIDS, the jail authorities shall take proper steps in treating him.

Miscellaneous petitions pending if any this Criminal Petition shall stand closed.
