HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2044 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner seeking to set aside the order dated 07-01-2016 passed in Crl.M.P.No.447 of 2015 in M.C.No.114 of 2015 on the file of the Court of the Additional Metropolitan Sessions Judge for the trial of Jubilee Hills Car Bomb Blast Case-cum-Additional Family Courtcum-IX Additional Metropolitan Sessions Judge at Hyderabad.

Respondent Nos.2 to 4 filed the above application viz., Crl.M.P.No.447 of 2015 claiming interim maintenance at the rate of Rs.15,000/- per month to Respondent No.2 and at the rate of Rs.10,000/- per month each to Respondent Nos.3 and 4 on the ground that the petitioner neglected to look after them.

The Court below granted interim maintenance of Rs.7,000/- per month to Respondent No.2 and Rs.6,000/- per month each to Respondent Nos.3 and 4. Aggrieved by the same, the petitioner filed the present Criminal Petition.

Heard and perused the material available on

record.

Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Petition is disposed of modifying the impugned order as follows:

The petitioner is directed to pay maintenance at the rate of Rs.3,500/- (Rupees Three Thousand and Five Hundred only) per month to Respondent No.2 and Rs.3,000/- (Rupees Three Thousand only) per month each to Respondent Nos.3 and 4 from the date of the above Crl.M.P. and he is also directed to pay the maintenance at the same rate on or before 10th of every succeeding month till the disposal of M.C. and he is also directed to pay the arrears of maintenance, if any, at the same rate within three months from today. The trial Court is directed to dispose of the M.C. as expeditiously as possible without being influenced by this order and the impugned order.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, in this Criminal Petition are closed.
