THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.11408 OF 2017 Dated:04.04.2017 Between:
Korrivi Srinivas Reddy, S/o. Korrivi Kota Reddy, Aged about 43 years, Occ: Armed Guard at SBI, R/o. 7-16-97C, 7th Ward 16th Block, Pandu Ranga Reddy Nagar, Giddalur, Prakasam District .. Petitioner And State Bank of India, General Manager, 5th Floor, Bank street, Koti, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.11408 of 2017 ORDER:
Petitioner earlier served in Army. Based on his service in Army, he was employed as Armed Guard in the respondent - Bank. While he was working in Podili, he was transferred to Giddaluru where he joined on 10.02.2016. Family of the petitioner lives in Giddaluru. Thereafter, the petitioner was shifted to Chinaganjam on 30.12.2016 and by the order impugned in the Writ Petition, the petitioner is now shifted from Chinaganjam to Cumbam. Aggrieved by the same, the petitioner filed this Writ Petition. 2.
It is not in dispute that the petitioner is Armed Guard and he requires high amount of alertness, promptitude and due obedience of the orders of the superior officers. It appears from the material on record, there was some kind of misunderstanding between the Chief Manager and the petitioner. Therefore, the petitioner was shifted from present place to Cumbum. It is not in dispute that the post of the petitioner is transferable and he cannot insist his continuation in a particular place. Hence, I do not see any illegality in the order impugned in the Writ Petition. 3.
At this stage, learned counsel for the petitioner submits that the petitioner expressed his personal difficulties with reference to his family and requested the competent authority for posting to Giddalur or to any other nearby place, so that he can take care of his family. In his representation he further stated that his children are studying and their education would be affected, if he is transferred to a far of place. Therefore, while upholding the
transfer of the petitioner, the Regional Manager of the respondent - Bank is directed to examine the representation, dated 14.02.2017, submitted by the petitioner with regard to his claim for transfer to a nearby place, where his family is residing or to Giddaluru and take appropriate decision as warranted by law uninfluenced by the dismissal of the Writ Petition.
4.
With the above observation, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
