The New India Assurance Company Limited, v. Gongati Ravi Kumar Reddy,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO MACMAMP.No.3315 of 2010 IN/AND MACMA.No.404 of 2016 COMMON JUDGMENT:
Learned counsel for the appellant submits that this appeal is a part of batch of appeals preferred by the insurance company and those appeals were dismissed, but however reducing the rate of interest from 9% to 8%.
2. But, in view of the view taken by this Court in a recent decision, interference in the 9% rate of interest cannot be made. Hence, MACMAMP.No.3315 of 2010, filed for condonation of delay of 99 days in filing the present appeal, is ordered, but the appeal is dismissed on merits holding that the rate of interest awarded by the Tribunal does not warrant any interference.
3.
The appeal is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ______________________________ A.RAMALINGESWARA RAO, J Date: 11.02.2016 TJMR
