THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.28649 of 2017 ORDER:

Heard the learned counsel for petitioner and learned Government Pleader for Revenue appearing for respondent Nos.1 to 3.

The petitioner had applied on 29-03-2016 for grant of money lending licence under the provisions of the Andhra Pradesh (Telanga Area) Money Lending Act, 1349 Fasli to the 2nd respondent. Under Rule 11 of the Rules framed under the said Act, such application is required to be disposed of within two (02) weeks. 3.

Petitioner complains that even though more than 11⁄2 year has passed since filing of the application, nothing is being done by 2nd respondent.

The matter had come up on 28-08-2017 and time was granted to the learned Government Pleader for Revenue to obtain instructions and it was adjourned to 04-09-2017. Matter was again listed on 31-10-2017 and it was posted to today for getting instructions. Though matter relates to Hyderabad, which is local, and though considerable time has been granted to the learned Government Pleader to obtain instructions, he again seeks time to get instructions. It is clear that for extraneous reasons the petitioner's application dt.29-03-2016 is not being disposed of by 2nd respondent in spite of the statutory mandate to decide it in two (02) weeks.

Therefore, the Writ Petition is allowed with costs of Rs.10,000/- (Rupees Ten Thousand only) to be paid by 2nd respondent to the petitioner, and the 2nd respondent is directed to pass an order within one week from the date of receipt of copy of this order positively and without fail on petitioner's application dt.29-03-2016. 6.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
