HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5436 of 2016 ORDER :

Heard both sides at length.

While setting aside the impugned order dated 26.09.2016 in E.P.No.53 of 2007 on the file of I Senior Civil Court, City Civil Court, Hyderabad, to conduct fresh enquiry as what is due after receiving calculations from the Land Acquisition Officer and BSNL, i.e., J.Dr.Nos.1 and 2 respectively, and also the decree holder, if any, which is subject to condition of the revision petitioner-J.Dr.No.2, for itself and on behalf of J.Dr.No.1, to deposit Rs.1,00,00,000/- (Rupees One Crore only) within four weeks from today i.e., on or before 31.12.2016 and to file calculation memo and participate in the enquiry as directed supra.

It is made clear that, if Rs.1,00,00,000/- is not paid/deposited by 31.12.2016, this conditional order ceases its force and order of lower Court holds good consequently.

The lower Court subject to the above compliance and filing of calculation memos, shall conduct enquiry afresh to determine what is due and if anything found due and payable so to direct to pay by enforcing the modes of execution. The fresh enquiry directed supra to be conducted by the lower Court shall be completed by end of March, 2017. The lower Court is also for purposes of the fresh enquiry and by virtue of this order is entitled to compel the J.Dr.No.1/LAO to appear before the Court to comply the above order to file calculation

or atleast to assist the J.Dr.No.2/BSNL/revision petitioner in filing the calculations.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
