THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE K. LAKSHMAN CONTEMPT CASE No.2 7 4 2 of 2 0 1 8 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging wilful disobedience to the order dated 25.04.2018 passed in WP.No.26287 of 2014. 2.

We are now informed by the learned Assistant Government Pleader for Home that the said order was subjected to challenge before the Supreme Court in SLP(Civil).Diary No.45455 of 2018. By order dated 14.12.2018, the Supreme Court modified the order passed in the writ petition to the effect that the petitioner herein should be made to undergo a physical test to ascertain his fitness before being reinstated in service as a Home Guard on par with others similarly situated. The Supreme Court further observed that in the light of this modification the contempt proceedings initiated for non-compliance of the order dated 25.04.2018 passed in the writ petition should not be proceeded with. Copy of the order passed by the Supreme Court is placed on record. In the light thereof, this contempt no longer survives for consideration on merits.

The contempt case is accordingly dismissed.

Pending miscellaneous petitions, if any, shall stand dismissed. There shall be no order as to costs.
