HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.19622 OF 2017 ORDER:
Heard the learned counsel for the petitioner and the learned Govt.Pleader representing respondents 1 to 3, before ordering notice to the unofficial respondent No.4 and perused the Writ Petition prayer, supporting affidavit and also other relevant material on record.
This Writ Petition is filed by the petitioner with the prayer which reads as follows:- " To issue an appropriate writ, Order or direction more particularly a Writ in the nature of Mandamus declaring the action of the Official Respondents permitting the 4t h respondent for Digging Fresh Water Acquaculture Fish Pond in the lands in Sy.Nos.452-1Ac.1-15cents, 451-1-Ac.0.20cents, 452-1-Ac.2.50 cents, 453-2Ac.2.50cents, 452-1-Ac.0.30cents,453-2-Ac.1.50cents, situated in Kondikupa village, Katrenikona Mandal, East Godavari District, without obtaining any permission under G.O.Ms.7 dated 16.03.2013 as illegal, arbitrary, and violation of principle of natural justice and contrary to G.O.Ms.No.7 dated 16.03.
2013 and also contrary to Andhra Pradesh Water, Land and Trees Act, 2002, and consequently direct the Official respondents to stop the Fresh Water Acquaculture Pond in the lands in sy.Nos.452-1-Ac.1.15cents, 453-1-Ac.0.20cents, 452-1-Ac.2.50cents, 453-2-Ac. 2.50 cents, 452-1-Ac.0.30cents, 453-2Ac.1.50cents, situated in Kondikuppa village, Katrenikona Mandal, East Godavari District and pass order or orders as this Hon'ble Court may deem fit in the circumstances of the case" The written instructions received by the learned Govt. Pleader shows that they did not accord any permission to the 4th respondent for digging any fresh water aquaculture fish pond or prawn in the extents mentioned supra in the Writ Petition prayer and they are going to take recourse not to allow him without permission if at all applied.
Having regard to the above by recording the same, the writ petition is disposed of directing the respondents 1 to 3 not to allow the 4th respondent, to dig or cultivate any fish tank or pond without proper approval and permission by following due process of law.
As a sequel, miscellaneous petitions if any pending in this Writ Petition shall stand closed.
