CRIMINAL PETITION NO. 13559 OF 2016 O R D E R :
On being mentioned, by Smt. G. Bhanupriya, learned counsel for the Petitioner/A-18, the present criminal petition is taken up for direction.
2. Learned counsel for the petitioner/A-18 submits that the petitioner/A-18 could not get the order passed by this Court on 28/10/2016, whereby directed to surrender before the trial court. Thus, the petitioner was unable to surrender. For some urgent work, the petitioner is required at home, therefore, seeks three days extension of time to surrender before the trial court.
3. On 28/10/2016, this Court passed the following order : After arguing the case for some time, the learned counsel for the petitioner/A-18 seeks permission of this Court to withdraw the criminal petition. He submits that the petitioner will surrender before the Station House Officer, Chandragiri Police Station, Chittoor district in Crime No. 44 of 2016 and move the trial court for bail.
Let the petitioner/A-18 surrender on or before 31/10/2016 and till then he shall not be arrested.
It is made clear that if the petitioner moves bail application, the trial court shall consider the same as per law. With the above direction, the criminal petition is disposed of. No costs.
3. Keeping in view, the submission of learned counsel for the petitioner, I hereby modify the order dated 28/10/2016 passed in this criminal petition and direct the petitioner/A-18 to surrender before the trial Court positively on or before 05/11/2016 in Crime No. 44 of 2016 of Chandragiri Police Station, Tirupati Urban, Chittoor district.
4. In view of the above direction, the order dated 28/10/2016 passed in this criminal petition is modified. ___________________________________ JUSTICE SURESH KUMAR KAIT.
