THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.10531 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., questioning the order, dated 18.07.2018, passed in Crl.M.P.No.207 of 2018 in C.C.No.369 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate Mahila Court, Hyderabad. 2.

Petitioners are A.1 and A.2, who filed the aforesaid Miscellaneous Petition under Section 242 (3) Cr.P.C., to defer the cross-examination of L.Ws.1 to 3 along with L.Ws. 4 and 5. The Court below, after perusing the material available on record, dismissed the application. Challenging the same the present petition is filed.

Heard learned counsel for the petitioners and the learned Public Prosecutor appearing for the respondent-police. 4.

At the hearing, learned counsel for the petitioners requested this Court to issue a direction to trial Court to dispose of the aforesaid Calendar Case expeditiously as it is of the year 2011. 5.

The offences allegedly committed by the petitioners are punishable under the provisions of Dowry Prohibition Act. As per Rule 5 (c) of the Andhra Pradesh Dowry Prohibition Rules (for short, 'the Rules'), the complaint shall be made, on demand of dowry or accepting dowry, within a period of one year and the according to Rule 10 of the Rules, the same shall be finalized within two (2) years from the date of filing of such complaint. The Calendar Case is of the year 2011 and two years time prescribed

under Rule 10 of the Rules has already been elapsed. Therefore, taking into consideration the facts and circumstances of the case, I deem it appropriate to issue a necessary direction to the Court below to dispose of the Calendar Case as expeditiously as possible. 6.

Accordingly, the Criminal Petition is disposed of directing the Court below to dispose of C.C.No.369 of 2011 on the file of XIII Additional Chief Metropolitan Magistrate Mahila Court, Hyderabad, as expeditiously as possible, in any event, not later than four (4) months from today.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
