ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.82 of 2016 of Kadiri Town Police Station, Ananthapur District, registered for the offence punishable under Section 506 IPC and under Section 3(1) (x) of SCs & STs (POA) Act, against him.

2. It is alleged in the complaint that on 12.04.2016 at about 7.30 PM, while the de facto complainant was coming from Kummaravandlapalli Village to go to Kadiri for medicines, the accused abused her in filthy language in the name of her caste and also threatened her with dire consequences due to ill feelings between them. Based on the complaint, the aforesaid crime was registered against the accused.

3. It is submitted by the learned counsel for the petitioner that the de facto complainant is in the habit of lodging the complaint as she filed complaints earlier against the wife of the petitioner and also against his friends and those complaints were closed by the investigating agency as false and now, the present complaint is filed falsely against the petitioner.

4. Considering the said facts and circumstances of the case and in view of the allegations made in the complaint, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/accused and file a final report, if any, in accordance with law. The petitioner/accused is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

4. With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
