SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.10503 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is A-1, in Crime No.26 of 2018 on the file of the Station House Officer, Jaddangi Police Station, East Godavari District. 2.

The offence alleged is under Section 8(c) R/w.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act'). 3.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

Learned counsel for the petitioner submits that the petitioner is only a driver.

But, the learned Public Prosecutor refutes the said contention and contends that the petitioner made a confession before the Police stating that, in order to make more money, he started doing business and that he got into this ganza business.

Thus, there is a clear statement made by the petitioner in his confessional statement that he along with other accused was involved in the ganza business. 7.

Hence, in view of the above and also considering the fact that 125 K.Gs. of ganza is involved in this case, which is far above the commercial quantity, in which case Section 37 of the Act comes in the way of granting bail to the petitioner, this Court is not inclined to grant bail to the petitioner. 8.

Accordingly, the Criminal Petition is dismissed. 9.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
