THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.39559 OF 2012 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"issue a Writ order or Direction more particularly one in the nature of Writ of Mandamus declaring the high handed action of the 2nd Respondent herein in registering F.I.R. No.342 of 2012 on 18-12-2012, U/s.447 IPC and 379 IPC, against the Petitions 1 to 3 herein out of personal grudge and upon the instructions of the 3rd Respondent which is an unwarranted interference in civil disputes of the 4th Petitioner and the 3rd Respondent herein as highly illegal, arbitrary and unconstitutional and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
2. When the matter is called, reiterating the written instructions dated 08.12.2015, furnished by the Station House Officer, Peddapalli Police Station, Karimnagar District, it is submitted by the learned Government Pleader that the police already filed a charge sheet vide C.C.No.452/2013 on the file of Court of Judicial First Class Magistrate, Peddapalli, on 08.05.2013 and a copy of the said charge sheet is also placed on record. In view of the above, nothing remains for adjudication further in this writ petition.
3. On noticing the same, it is requested by the learned counsel for petitioner to permit the petitioner to assail the charge sheet.
4. For the aforesaid reasons, Writ Petition is disposed of, keeping it open for the petitioner to assail the charge sheet, if the petitioner is advised to do so.
5. Miscellaneous Petitions, if any, pending shall stand closed. No costs.
