SMT JUSTICE T. RAJANI CRIMINAL PETITION No.10505 of 2018 ORDER:
This Criminal Petition is filed under Section 438 Cr.P.C. seeking grant of anticipatory bail to the petitioner, who is A.1, in Crime No.170 of 2018 on the file of Chapadu Police Station, YSR Kadapa District, registered for the offences punishable under Sections 307 and 324 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that while the de facto complainant was laying pipes through the land of the petitioner, the petitioner came and beat the de facto saying that why you are laying pipes in my land.

Learned counsel for the petitioner submits that the petitioner also filed counter case against the de facto complainant on the same date of filing of complaint by the de facto complainant. 5.
Since the facts of the case in the complaint filed by the petitioner would show that there was some altercation between the parties and the medical record pertaining to the de facto complainant, in this case, filed by the learned Public Prosecutor, shows that there was injury on the parietal region, considering the same, this Court finds that it is not a fit case to grant Anticipatory Bail to the petitioner.

Accordingly, the Criminal Petition is dismissed, however the petitioner is at liberty to file a petition seeking regular bail before the Court concerned, in which event, the Court shall consider the petition on the same day subject to pressure of the other work. _____________ T.
