THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24488 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India challenges the action of the respondents herein in not passing any orders on the application, dated 16-03-2015 submitted by the petitioner herein for issuance of Arms License. Heard Sri Bethi Venkateshwarlu, learned counsel for the petitioner and learned Government Pleaders for Home and Revenue for respondents, apart from perusing the material available before this Court.
According to the petitioner, he is a permanent resident of Muthireddy Gudem village of Bhongir mandal, Nalgonda district and in the elections held for Gram Panchayat in the year 2006 the petitioner herein got elected as Ward Member for 10th ward. According to the petitioner, he submitted an application on 03-042012 for Armed License and when there was inaction on the part of the respondent authorities in considering the said application, the petitioner herein filed W.P.No.10453 of 2013 and this Court granted interim direction on 23-12-2013, directing the District Collector to consider the said application and the said application was subsequently rejected by the District Collector. It is the case of the petitioner herein now in the present writ petition that in view of continuous life threat for him from the accused in S.C.No.42 of 2008, he submitted an application once again on 16-03-2015 with the District Collector, Nalgonda - 3rd respondent herein, requesting for Arms License. It is the further grievance of the petitioner herein that even though he approached
respondent authorities quite a number of times no action has been taken on his application, dated 16-03-2015. Therefore, this Court is of the considered opinion that the ends of justice would be met if a direction is issued to the 3rd respondent herein - District Collector, Nalgonda to pass appropriate orders on the application, dated 1603-2015 submitted by the petitioner herein for grant of Arms License by fixing some time frame.
For the aforesaid reasons and having regard to the nature of controversy, the writ petition is disposed of, directing the 3rd respondent to consider the application, dated 16-03-2015 said to have been submitted by the petitioner herein for grant of Arms License and pass appropriate orders, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
