When the matter is taken up, the written instructions furnished by the Inspector of Police & S.H.O., Old Guntur P.S., Guntur Urban, dated 29.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that on receipt of the report from the petitioner, a case in Cr.No.114/ 2018, under Sections 420, 417 and 419 r/ w 34 I.P.C., has been registered by me on 02.05.2018, against the accused A.1 to A.5 as A.1, who is friend of the father of Desu Khaja Babu, who died on 23.03.2002, due to ill-health at Govt.Fever Hospital, Gorantla, Guntur, of the petitioner, created forged documents by purchasing the vacant site 159 Sq.Yds., in D.No.524, 525 situated at RVC Venchers, Vasavinagar, Guntur, belongs to the father of the petitioner vide Registration No.6665/ 1995 with cost of Rs.
64,000/ - on 11.05.2005 and registered the same as document No.6783/ 2005 at Sub-Register Office, Guntur, after the death of the father of the petitioner by creating as he was alive. Later, the accused A.1 gave General Power of Attorney and sale deed agreement to A.5 with a cost of Rs.1,42,000/ - on 01.08.2007 and registered the same at Sub-Register Office, Guntur vide document No.11202/ 2007, then A.5 sold the same to A.2, A.3 and A.5 and registered in SubRegister Office vide documents No.14548/ 07, dated 13.12.2007, document No.
13.12.2007, document No.3542/ 2009, dated 16.09.2009.
It is further submitted that during the course of investigation, I visited the scene of offence, prepared rough sketch of the same as many as 2 witnesses have been examined u/ s.161 Cr.P.C.,, and also recorded their detailed statements in part-II of my case diary. I then also obtained true copies of above mentioned documents involved in the case from Sub-Register, Guntur, and perusing the same. The investigation is in progress cines some more witnesses have to be examined and apprehension of the accused."
Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition, by placing on record the said instructions, with a direction to the respondents herein to complete the investigation, as expeditiously as possible, and file a final report.
